What is an Abandoned Property?

August 14, 2025

Occasionally, properties are abandoned, derelict or unregistered. It is possible to claim abandoned land and property, but the procedure is intricate. Sometimes, these properties end up being owned by The Crown, or the Government, if they are long-term abandoned. To learn more about the UK’s laws regarding abandoned properties, continue reading.

When is a Property Considered Abandoned?

The UK is home to thousands of abandoned sites, some of which are properties. The exact moment at which a property is deemed abandoned is not governed by any written law. It does, however, specify that an abandoned property is one whose owner has consciously relinquished possession or claim to it. A property that is uninhabited for any of the following reasons is considered an abandoned property:

  • The owner might not have made their mortgage payments on time.
  • The owner has declared bankruptcy
  • The owner has gone missing
  • The property’s inherited owner was untraceable

In summary, property abandonment occurs when a property owner voluntarily relinquishes their ownership of the property, either by leaving the premises unattended or explicitly acknowledging the abandonment.

Abandoned Property in the UK

Over 200,000 properties in the UK are vacant. A startling realisation, given the housing shortage and the expense of living crisis, is that some properties have been vacant for more than six months or perhaps a year. Many of these unoccupied properties are located in coastal communities with high unemployment rates. Nevertheless, in recent years, the number of vacant homes in London, Liverpool, and Birmingham has increased.

Different Types of Abandoned Land

A property can remain unoccupied for years without being considered abandoned. Holiday homes and military residences are not examples of abandoned properties, but they could be vacant for months at a time. The value of neighbouring properties may suffer if there are long-term unoccupied properties. Nevertheless, they are still not regarded as abandoned unless the owner voluntarily vacates the property and relinquishes their rights.

In the United Kingdom, an abandoned land must be fenced off for a specified period before the owner can return and reclaim it. To achieve this, they would have to provide proof of legal title.

Permanently Abandoned Property

If a building is boarded up or has significant structural damage, it is likely a permanently abandoned land. It might also have an untidy, overgrown garden with trash in it.
